Find a Question:
A German court has not made a warranty Apple
The district court in Berlin found 16 items warranty Apple unacceptable and violates the rights of German consumers. It is reported by Kommersant referring to the German Society for the Protection of Consumer Rights (VZBV).
According to the judge, 16 points, 11 of which belong to the limited warranty as well as 5 – paid to the extended warranty Apple Care Protection Plan, «invalidate the warranty promises and make them meaningless.” The lawsuit was filed against VZBV Apple Distribution International.
The Court, inter alia, considered unacceptable point, according to which the guarantee applies to the device only in the case of “normal use” in accordance with “post a user manual.” According to the judge, such reservations devalue themselves by the warranty, the more that a clear definition of what is meant by normal use, no.
The court also declared invalid point that the warranty does not cover defects such as scratches and dents, as they “do not adversely affect the operation of the product and does not significantly affect its use.” Also a violation of paragraph guarantees which, if the device needs repair abroad, shipping costs borne by the user. Moreover, the court pointed out that Apple provided a free one-year warranty for abuse – the law guarantee should be valid for two years. According to the Court, the obligations of the manufacturer can not replace the statutory requirements for the warranty, but only complement them.
Even in 2012, the organization for the protection of consumers’ rights from 11 European countries alleged violations related to the guarantee fee AppleCare Protection Plan. According to them, Apple advertised paid guaranteed without providing consumers with complete information about installed European laws manufacturer’s warranty.
As the head of VZBV to implement the right HELCOM Heidemann-Proyzer, today 16 points warranty has been revised and the corporation “Apple must now verify whether they are laid down by the court requirements.”
