Lawyer Jaroslav Mikhailov and lawyer Ksenia Korczak on behalf of the user’s iPad from Crimea sued Apple. The plaintiffs argue that the American corporation illegally denied access to update the operating system and applications for mobile devices officially acquired.
As told by Yaroslav Mikhailov, she bought a tablet yet in Ukraine. Some time after the purchase, it was forced to move from Lugansk to the Crimea. There, after the imposition of sanctions, the gadget has ceased to update the software and download the application has become impossible.
“We believe that in this case have been violated consumer rights. The girl bought iPad before the imposition of sanctions, so they should not touch her gadget. We put the question of the illegality of the actions of the company and demand update the software, as well as provide an opportunity to get an application, “- said the Kirov lawyer.
According to the lawyer, the claim will be considered in the Railway Court of Simferopol. It is possible that in the future will require a resident of the Crimea from Apple and monetary compensation for moral harm.
On Monday, the “social consumer initiative” (PGI) filed a lawsuit to Apple. Human rights activists have accused the corporation that it violated Russian law by refusing to sell their products and provide services on the territory of Russia.
According to the law on consumer protection, any manufacturer is obliged to provide for the life of a product of its maintenance, as well as the production and supply of spare parts. Therefore, Apple has no legal grounds for restricting the supply of goods and spare parts in the organization based on their location, the report said.
Earlier, Russian representation Apple – LLC “Apple Rus” – beginning to notify their partners to ban the sale of their units on the territory of Crimea because of the sanctions imposed by the US government. In dispatch retailers Apple refers to the section “Obligations in relation to exports” agreement with the dealer.
