Apple plans to appeal against a ruling by an American court, which ruled that there is no justification for a sales ban on Samsung smartphones appeal. According to Judge Lucy Koh Apple has not sufficiently demonstrated that it has “significant” suffered from the sale of Samsung smartphones that infringe on Apple patents, as reported The New York Times. Also, Apple has not demonstrated that the alleged damage was caused by patent infringement from Samsung.
In another lawsuit between Apple and Samsung has already been held that the latter must pay patent infringement damages. That sum amounted to the equivalent of some 86 million euros. However, the amount was significantly lower than the approximately 1.6 billion euros in damages where Apple had asked for, which all appeal was lodged . Incidentally, Samsung went in appeal against the damages imposed.
