Apple wants to deprive the rights to the brand iPhone in India

According to news agency Indiatimes, Apple may lose the right to use the brand iPhone in the Indian market. The reason – the claim by a local firm iVoice Enterprises.

In 2007, iVoice Enterprises of Tamil Nadu has registered its own brand iFone (India Phone). This week, the company turned to the organization responsible for the intellectual property rights of Intellectual Property Rights (IPR), with the requirement to exclude from the list of brand iPhone, which is “too in tune” with the name iFone.

“When, in May 2007, we filed a trademark registration, Apple still only planned to announce their brand. Only in 2008, came out with a product trademark. In India, the phone appeared only in 2009, “- said the head of iVoice.

iVoice Enterprises acquired the rights to the trademark iFone in 2007 – at the same time with the presentation of the first model of iPhone. In this case your phone Indians never released. Nevertheless, companies expect to reach the exclusive rights to use the brand in the country.

Specific requirements on the part of the plaintiff is not yet known. Perhaps, iVoice require compensation for the use of the name of the iPhone or even the percentage of sales of mobile phones Apple. In any case, if Apple can not agree with iVoice Enterprises, the US company will lose the right to the word of the iPhone in India.

IPR demanded that Apple official comment on the claims iVoice Enterprises to “apple” brand.
