Bundeskartellamt terminates proceedings against Amazon

The Federal Cartel Office had already launched a lawsuit against Amazon and its subsidiary Audible as well as Apple at the end of 2015. The stumbling blocks were certain contractual clauses, which guaranteed Apple the exclusive rights to the digital distribution of certain audiobooks. As a result, Apple was able to offer many titles on its own with the agreement with Audible – other providers were left out. At the same time Apple had also to bind Audible. The Bundeskartellamt saw this as a problem for the competition. Amazon / Audible and Apple have now yielded and these clauses were shelved. The effect will come into effect in January 2017.
