Download Prohibition: paper tiger? – The prohibition that nobody abides




Last April the download ban came into force. Meanwhile, there is no one prosecuted yet. Is the ban on downloading a paper tiger or walk downloaders actually in danger?

For a long time in the Netherlands a relatively rare situation: downloading copyrighted movies, TV shows and music from ‘evidently illegal source’ as it is called so beautiful, was permitted, but not upload. It was a bit like the tolerance for soft drugs. You may not smoking, but growing and selling coffee shops is prohibited. A situation where societies as Brein were not happy.April last year that changed abruptly when the European Court of Justice ruled that the Netherlands should not allow the download of such material. Thanks to the judgment of the highest judicial body in the European Union Netherlands got an immediate ban on downloading movies and music from illegal sources – something that was true some time for games and other software.

After ten months, however, there is no one brought to trial. This may give the impression that the download prohibition in practice is not, especially because Brein sharers has indicated that it will not tackle. Instead, the frequent uploaders such release groups, and the sites on which the material is spread, addressed.

But does that mean that the ban actually download is a paper tiger? Tweakers delved into the issue, and has a mixed message for frequent downloaders.
