EU Court: municipalities may levy taxes on masts mobile carriers




Municipalities may levy taxes on masts of mobile carriers. That the European Court of Justice said in response to questions from a Belgian court. It does not mean the end of the legal battle between providers and Belgian municipalities.

The European Court of Justice ruled that the tax on cell towers is justified, but this ‘pylon tax’ must be non-discriminatory. Municipalities can not impose a higher amount than one service provider to another.
