As said Friday Ilya Ischuk representing Akita, commercial intermediaries – electronic shopping malls, accumulating information about the proposals (to them he took such sites as “of Yandex.Market», Price.ru, «Goods @ Mail.ru», Wikimart) – provide 65-85% of the traffic to online retailers who are actively involved in advertising goods and selling them through the Internet. At the same time they “do not check their advertisers, denied responsibility for the accuracy and integrity of advertising and compliance with the legislation on intellectual property,” the de facto being out of control under the existing regulation. Formally responsible to the buyers and owners shall be an online store, but in practice its implementation is difficult.


Respond to the accusations against intermediaries had to “Yandex”. Lead Counsel of the company Sergey Kuchushev pointed out that the “Market” – a service for all participants in e-commerce, promoting the awareness of customers, lower costs, and hence the growth of competition. “It’s 16,000 stores, 70 million product offerings and 20 million unique visitors per month – reasoned Mr. Kuchushev.- If people are not satisfied with the work,” Market “, they would not come to us again and again.” At the same time, according to statistics given to them, stores get only 5.16% of the traffic directly from such advertising systems as “Market” (direct calls and search engines provide approximately 35% of the traffic, follow the link on the sites – about 25%).

According to the lawyer, if the copyright holder files a complaint with the legal basis for a copy or counterfeit goods, the store immediately removed and never in the service does not appear.

As a result, Deputy Head of FAS Andrey Kashevarov proposed “together to work out the rules for selling goods over the Internet, similar to the Code of Conduct for automakers that governs their relationship with dealers.” Otherwise, warned Mr. Kashevarov be like with retail chains that do not come to a consensus and “received the law” On Trade “.
