Organizations want to prevent the introduction of unmodified tapping law with summary proceedings
Various civil society organizations, such as Privacy First, Bits of Freedom and the Dutch Association of Criminal Defense Attorneys, may go to court to prevent the entry into force of the interception law or ‘sleep law’ until it has been adjusted.

The coalition of civil society organizations asks the government to postpone the introduction of the new Wiv , or in any case ‘the most privacy-violating parts’, until all legislative changes in parliament have been dealt with. If the government does not comply with this, the organizations will try to prevent the law from coming into effect by means of summary proceedings.

Privacy First states that law will lead to a massive privacy violation and therefore finds that later legislative changes can not be awaited, because the violation of the right to privacy has already taken place. The government intends to introduce the law on 1 May, with the promised changes only being implemented later. This concerns an adjustment of the targeted interception, the sharing of data with foreign intelligence services and the storage period of stored communication data.

On Wednesday, the coalition will hand over a letter with this demand to several members of the Dutch cabinet. In this, the organizations will give the cabinet time to respond to this on Friday. Because it directs on an entry into force on May 1, any summary proceedings and the ruling must take place within two weeks. A lawsuit is a brief procedure at the court that is only open to emergency cases.

The new Wiv, also known as the draining act or ‘sleep law’, is adjusted on the basis of the outcome of the referendum that took place in March. The Electoral Council reported that 49.44 per cent of voters voted against the law, while 46.53 per cent showed their support. According to the government, the amendments to the law are enough to do justice to the outcome of the referendum.
