Judge: The judge of the Central Netherlands court has ruled that, despite the use of the Autopilot system, the person behind the wheel of a Tesla can be regarded as the actual driver of the vehicle.

The subdistrict court made the statements in two cases filed by a possessor of a Tesla Model X who had been fined for driving on 10 and 16 October while driving. The man argued that not he, but the activated Autopilot as driver, was to be considered, since the software ensures that the car can autonomously steer and brake, without the intervention of a person is necessary. He referred as an example to a driving instructor, who is also not regarded as a de facto driver, only supervises the driver and therefore can call.

His arguments did not stand up according to the judge, who referred to the Road Traffic Act, which states that the driver is the person who drives the motor vehicle or ‘the person who is supposed to drive the motor vehicle under his immediate supervision’.

According to the subdistrict judge, the actual driver of a car determines where the car goes and how to act in emergency situations. It is also responsible for what the car does. The judge also referred to a statement from Tesla: “When using Autopilot, the driver must always pay attention and remain active and be ready to intervene at any time”. In addition, the judge claims that the man himself admitted to having to grab the wheel regularly.
