Police and tax authorities will receive automated access




to bank data at the end of this year
In the second half of this year, the Bank Data Referral Portal has to be put into use. Through this portal, banks must automatically receive requests from the police, the Public Prosecution Service and the Tax Authorities, which serve to hand over personal data.

Initially, the Bank Data Referral Portal, or VB, would be put into use on 1 July 2019, but this was postponed to 31 December 2019 at the latest. This gives banks more time to connect to the portal. Minister Grapperhaus of Justice and Security reports this in an explanation to an Advisory Report from the ICT Assessment Office about the Bank Data Referral Portal.

On the basis of the Banking Referral Bill , banks and other financial institutions that offer invoices with an iban number, will soon have to join the VB. The minister will send the proposal to the Lower House this spring. Via the portal, the police, the special investigative services, the Public Prosecution Service, the Financial Intelligence Unit Netherlands and the Tax Authorities can automatically retrieve personal data about customers. This should help them to combat fraud and investigate unusual transactions.

In the current procedure, banks must manually extract ‘identifying personal data’ from their systems. A large bank involves thousands of requests per year, which makes it a labor-intensive process according to the Minister. The ICT Assessment Office agrees with the minister, but does criticize the existing plans for the VB.

For example, this organization, which tests ICT projects of the government, observes, among other things, that the security measures can be improved. For example, the portal would be accessible via the closed but wide government network Rijksweb and no two-stage authentication would have been introduced. The minister promises that the ultimate portal will be approached via the safer network of the Ministry of Justice & Security.

The ICT Testing Office also advises that the portal of siem software should be provided in order to reveal security incidents and to be able to act quickly. The Minister promises that this software will be added before the commissioning. Furthermore, measures that banks guaranteed that the withdrawals actually came from the VB, but here too, according to Grapperhaus, work is being carried out.
